KITTEN SALES AGREEMENT

This document conveys the sale of a registered pedigreed Siberian Kitten as described below. Sale is by and between SiberianSnow (Breeder) and the Buyer as identified below.

Purchase price of Kitten is $1200 plus $300 shipping (includes airline ticket, carrier and health certificate), if required. Once kitten is delivered to the Buyer, Breeder is released of the welfare and care of the kitten. $200 Kitten Deposit must be received to hold a specific kitten. Balance in full is due within 10 days of deposit or by kitten’s 8th week, whichever one comes first. Shipping (if required) is due seven days prior to flight.

Conditions:(please initial next to each section)

_____1. Breeder guarantees the kitten will be vaccinated at approximately eight weeks and again at approximately twelve weeks. Buyer is now notified the kitten would be due the third vaccination in the series prior to sixteen weeks of age otherwise the series of three shots will have to be given again. In addition, the kitten will have preventative deworming per our veterinarians instruction. If Buyer requests kitten to be shipped he/she understands flight schedules are subject to weather, veterinarian exam, and health of kitten. Breeder and Buyer will determine date and time of shipping. Breeder guarantees kitten to be in excellent health at time of delivery, including two vaccinations and deworming. Breeder warrants it’s cattery is free from FeLV/FIV, infections, internal and external parasites, ear mites, fleas and ringworm (these are not hereditary/genetic).

_____2. After Buyer sends Breeder a veterinarian's certificate of neutering (this must be before they are 12 months), Breeder will fill out the registration with the kitten's name, Buyer’s personal information and mail it to TICA. Once TICA mails your kitten’s papers to breeder (which can take more than a month), Breeder will forward kitten’s papers to the Buyer’s address that has been provided.

_____3. Buyer accepts responsibility for the care and the welfare of the kitten/cat for the lifetime of the animal. This kitten will never be placed in an animal shelter or sold or leased to any pet store, animal shelter, breeding mill or research facility, etc.. Further, purchaser agrees not to sell, trade, give, lease or otherwise release the animal to any other breeder without the written permission of SiberianSnow. If SiberianSnow is unable to accept kitten/cat back, we will help you re-home your kitten/cat at Buyers expense if applicable (shipping, health certificate, etc.)

_____4. If a veterinary exam finds a major health problem within 14 days after delivery, Breeder will exchange Kitten at no cost or refund the purchase price less a non-refundable deposit of $200 and cost of shipping. Veterinary records must be provided and Buyer must contact Seller in advance.

_____5. Should Kitten die from or be diagnosed and with a serious congenital or hereditary disorder in the first two years of life, then, Breeder shall choose to replace Kitten without charge, or refund the purchase price if that said disorder is evidenced by an autopsy report by a licensed veterinarian.

_____6.Buyer agrees never to declaw the kitten/cat.

_____7. The Buyer agrees that they will furnish adequate indoor facilities for the kitten and further agrees that the kitten shall never be allowed to roam outside freely during the lifetime of the animal described herein.

_____8. Breeder will provide an invoice with amount of kitten, deposits received, amount due and due date upon receipt of contract and Kitten Deposit. If you require shipping, please complete the flight information at the bottom of this form. Should Buyer fail to make the Kitten Deposit within 72 hours, final payment by due date or cancel this agreement prior to the scheduled delivery of Kitten; Breeder reserves the right to sell Kitten to another party and retain up to $200 as a cancellation fee. Additional funds received above $200 by SiberianSnow, will be refunded once the kitten is sold and funds have been received by the new kitten buyer.

_____9. Should enforcement of any portion of this contract become necessary, all legal fees, court costs, travel expenses, and related expenditures incurred by the breeder will be the sole responsibility of the purchaser. This contract and the terms herein shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to this contract shall be filed only in the courts located in Fresno County, California to the exclusion of all other courts and purchaser hereby consents and submits to the personal jurisdiction of such courts for the purpose of litigating any such action. Should any portion of this contract be found invalid or unenforceable by a court of law, all remaining portions herein shall remain valid and fully enforceable.

This agreement supersedes previous negotiations and representations between the parties and may be altered only in writing and signed by both parties.
